He said he saw the accused beating on the water to attract the dolphins. He described the animals as �stressed out� and diving under the water for only a few seconds before coming up for air � behaviour he had never seen before, he told the court.
Another witness, Carol Scott, who works at the Macduff Marine Aquarium, described her reaction to the jetskier�s actions as 'shocked and disgusted� and said she could not understand how someone could do that to group of wild animals.
Mr Smith was taking the Puffin on a wildlife watching trip with five tourists from England and Germany. A group of between 15-20 dolphins, including calves were in the area, and a number came alongside the boat, swimming with it.
He described seeing a jet-ski come out of the harbour, approaching his boat at speed, near Faw Bat. He identified the driver as Nicol Wood.
The jet-ski stopped about 300 feet away, and the driver began to beat the water hard with his hand and foot � a method of attracting dolphins he had seen before, and in other countries, said Mr Smith
